TALIA SRL, with registered office in Via D. Cotugno 17 – Bari (BA), with VAT number 07527110725 is the owner and owner of the website www.domakale.it
which has as its purpose the online sale of textile products for the hotel and home sector and related products (including accessories).
Acceptance of the general conditions of sale 1. The contract stipulated between TALIA SRL and the Customer must be considered concluded with the acceptance, even if only partial, of the order by TALIA SRL. This acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions transcribed below.
2 If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure has been completed, he will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Articles 3 and 4 of Legislative Decree 185/1999 on distance selling.
3 Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance, even partial, of an order.
How to purchase 4. The Customer can only purchase the products present on the site at the time of placing the order and viewable online at www.domakale.it, as described in the relevant information sheets. It is understood that the image accompanying the description of a product may not be perfectly representative of its characteristics but may differ in color, size, accessory products shown in the figure. All purchase support information is intended as a simple generic information material, not referable to the real characteristics of a single product.
5 Correct receipt of the order is confirmed by TALIA SRL by means of an e-mail reply, sent to the e-mail address supplied by the Customer. This confirmation message will contain the date and time of execution of the order and a ‘Customer Order Number’, to be used in any further communication with TALIA SRL. The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document.
6 In case of non-acceptance of the order, TALIA SRL guarantees timely communication to the Customer.

Terms of payment

7 Credit card TALIA SRL has chosen as a bank for transactions through PAY PAL. In cases of purchase of goods with a credit card payment method, at the same time as the online transaction is concluded, the reference bank will authorize only the commitment of the amount relating to the purchase made. 7.1 In case of cancellation of the order, both by the Customer and in case of non-acceptance of the same by TALIA SRL, TALIA SRL will simultaneously request the cancellation of the transaction and the release of the committed amount. The release times, for some types of cards, depend exclusively on the banking system and can reach their natural expiry date (24th day from the date of authorization). Once the transaction has been canceled, in no case can TALIA SRL be held responsible for any damage, direct or indirect, caused by delay in the failure to release the amount committed by the customer’s banking system. 7.2. TALIA SRL reserves the right to request additional information from the Customer (eg landline phone number) or to send copies of documents proving ownership of the card used. In the absence of the required documentation, TALIA SRL reserves the right not to accept the order. 7.3 At no time during the purchase procedure is TALIA SRL able to know the information relating to the buyer’s credit card, transmitted via a secure connection directly to the PAY PAL site that manages the transaction. No computer archive of TALIA SRL will keep such data. In no case can TALIA SRL be held responsible for any fraudulent and improper use of credit cards by third parties, upon payment of products purchased on www.domakale.it
7b. Pay-Pal The PayPal form of payment is possible on all items in the catalog. Any limitations are clearly highlighted in the shopping cart. The crediting of the sums paid via Pay-Pal is instantaneous. Attention: in case of payment with Paypal, the shipment will MUST be made to the address indicated on the Paypal accountant. If you want a delivery to a different address, you must change the address via Paypal BEFORE payment. To register or change an address with PayPal: Go to PayPal (www.paypal.it) and log in to your account. Access your profile and update the postal address, or add a new address. If this is not possible, we recommend that you consider a payment method other than Paypal
8 Advance Bank Transfer / Postepay Top-up 8a. Advance Bank Transfer The Advance Bank Transfer form of payment is possible on all items in the catalog. Any limitations are clearly highlighted in the shopping cart. In case of payment by Advance Bank Transfer, what ordered by the Customer will be kept busy until the receipt of the proof of the transfer, to be sent to TALIA SRL (via fax or e-mail) no later than 3 working days from the date of acceptance of the ‘order. The dispatch of the order will take place only upon the actual crediting of the amount due to the current account of TALIA SRL which must take place within 7 working days from the date of acceptance of the order. Beyond these deadlines, the order will be considered automatically canceled.
The purpose of the bank transfer must include:

the order reference number;
the date the order was placed;
name and surname of the order holder.
Delivery methods and costs 9. For each order placed on www.domakale.it, TALIA SRL will issue an invoice for the material shipped, sending it by e-mail or by post to the holder of the order, pursuant to Article 14 of the Presidential Decree. 445/2000 and DL 52/2004 within 15 days from the shipment of the goods. For the issuance of the invoice, the information provided by the Customer at the time of the order is authentic. No change in the invoice will be possible after its issue.
10 Shipments are made at the Customer’s risk and peril. Delivery costs are charged to the customer. The payment of the goods by the Customer will take place using the method chosen at the time of the order. Nothing more is owed by the Customer with respect to the total order.

10a. Insurance: shipments can be insured. This service is optional and costs 1.5% of the value of the goods, with a minimum of € 5.00. If the customer wishes to purchase the insurance, he can contact us at the e-mail address info@domakale.it

We therefore recommend that you ALWAYS insure each shipment. IMPORTANT: in case of purchase of insurance, the customer is required to scrupulously check each package at the time of unloading, noting any damage found in detail on the slip that remains with the courier. Failing that, in the event of problems, we will not be able to proceed with the opening of the claim for compensation.

11 No responsibility can be attributed to TALIA SRL in case of delay in the order or delivery of the order.
12 Unless explicitly indicated by our Customer Service, delivery means at street level. Upon delivery of the goods by the courier, the customer is required to check.
that the number of packages delivered corresponds to what is indicated in the transport document sent in advance via e-mail;
that the packaging is intact, not damaged, wet or otherwise altered, even in the sealing materials (adhesive tape or metal straps).
Any damage or mismatch in the number of packages or information must be immediately reported to the courier who makes the delivery. Once the courier’s document has been signed, the Customer will not be able to make any objection about the external characteristics of what has been delivered. Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, in accordance with the procedures set out in this document. In case of non-collection within 5 days of the material present in storage at the courier’s warehouses due to repeated impossibility of delivery to the address indicated by the Customer at the time of the order, the order will be automatically canceled.
Right of withdrawal 13. Pursuant to Legislative Decree No. 206 of 06/09/2005, amended by Legislative Decree 21/2014, in implementation of Directive 2011/83 / EU, if the customer is a consumer (ie a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating a VAT number in the order form at www.domakale.it), has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as indicated in point 15 below.
14 To exercise this right, the customer must send domakale.it a communication to that effect within fourteen (14) days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgment of receipt, addressed to:
TALIA SRL VIA D.COTUGNO, 17 70100 BARI (BA) or by telegram or fax always sent within the aforementioned term of 10 days and followed by a confirmation by registered letter with acknowledgment of receipt, MUST be sent within the following 48 hours. Once we have received the aforementioned notice of withdrawal, the TALIA SRL Customer Service will quickly communicate to the customer the instructions on how to return the goods which must be received within 7 days of authorization.
15 The right of withdrawal is however subject to the following conditions:
the law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (eg: accessories, part of linen, etc …);
the purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); to limit damage to the original packaging, we recommend, when possible, to put it in a second box;
by law, the shipping costs for returning the goods are charged to the customer;
the shipment, up to the certificate of receipt in our warehouse, is under the complete responsibility of the customer;

in case of damage to the goods during transport, TALIA SRL will notify the customer of the incident (within 5 working days from receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier he has chosen and obtain a refund of the value of the asset (if insured); in this case, the product will be made available to the customer for its return, at the same time canceling the request for withdrawal;
TALIA SRL is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments;
upon its arrival in the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the package and / or the original packaging are damaged, TALIA SRL will deduct from the refund due a percentage, in any case not exceeding 10% of the same, as a contribution to the restoration costs.
16 Without prejudice to any repair costs for damage to the original packaging, TALIA SRL will refund the customer the full amount already paid, within 30 days from the withdrawal authorization, by means of a reversal of the amount charged to the credit card. or by bank transfer. In the latter case, it will be the customer’s responsibility to promptly provide the bank details on which to obtain the reimbursement (IBAN / current account number of the invoice holder).
17 The right of withdrawal is totally lost, for lack of the essential condition of integrity of the property (packaging and / or its contents), in cases where TALIA SRL ascertains:
the lack of the external packaging and / or the original internal packaging;
the absence of integral elements of the product (accessories, manuals, parts, …);
damage to the product for reasons other than its transport.
In case of forfeiture of the right of withdrawal, TALIA SRL will return the purchased good to the sender, charging the shipping costs to the sender.
Guarantees 18. All products sold by www.domakale.it are covered by the manufacturer’s conventional guarantee and by the 24-month guarantee for lack of conformity, pursuant to Legislative Decree 24/02. To use the warranty, the Customer must keep the invoice (or the DDT) that he will receive by e-mail or by post. 19. The manufacturer’s conventional warranty is provided in the manner illustrated in the documentation inside the product packaging. If, following intervention by an Authorized Service Center, the defect is not covered by the manufacturer’s conventional warranty, the Customer will be charged for any verification and restoration costs required by the Authorized Service, as well as transport costs, if supported by TALIA SRL.

20 The 24-month warranty pursuant to Legislative Decree 24/02 applies to products that show a lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and as provided in the attached technical documentation. This guarantee is reserved for the private consumer (a natural person who purchases the goods for purposes not related to his professional activity, or makes the purchase without indicating a VAT number in the order form). In the event of a lack of conformity, TALIA SRL provides, at no cost to the Customer, to restore the conformity of the product by repairing / replacing or reducing the price, until the contract is terminated. If, following intervention by an Authorized Assistance Center, the defect does not result in a lack of conformity pursuant to Legislative Decree 24/02, the Customer will be charged for any costs of verification and restoration required by the Authorized Assistance, as well as transport costs if incurred by TALIA SRL
21 The replacements in case of DOA (Dead On Arrival: product not working on delivery) take place only if expressly provided for by the manufacturer. The timing of replacement or repair of the product depends exclusively on the manufacturer’s policies.
22 Any aesthetic defects must be strictly reported within three days of receipt. By aesthetic defect we mean a problem such as to be disfiguring the object, without however compromising its correct functioning. Several manufacturers do not provide warranty coverage in the event of late reporting of aesthetic defects.
23 In the event that, for any reason, it is unable to return a product under warranty (restored or replaced) to its customer, TALIA SRL may proceed at its discretion to return the entire amount paid or to replace it with a product of equal or superior characteristics. No damage can be requested from TALIA SRL for any delays in carrying out repairs or replacements.
24 In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, etc … ) .Privacy 25. The personal data requested when placing the order are collected and processed in order to satisfy the express requests of the Customer and will in no case and for any reason be transferred to third parties and will not be used for sending advertising material, unless expressly consented by the customer.

Applicable law
27. The sales contract between the customer and TALIA SRL is concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes deriving from the conclusion of this remote sales contract, the territorial jurisdiction is exclusively that of the Court of Bari.
